It is reported on Sourceforge this week, the US Court of
Appeals for the Federal Circuit ruled that, yes, a software company has
infringed upon an open source project’s copyright by failing to adhere
to the terms of its license. Specifically, the Artistic License.
Open Source Software publishers, including Philip Copeman TurboCASH Project Leader and copyright owner of TurboCASH accounting was obviously thrilled about the decision. This means that our code is proptected from being taken, modified and closed to the community. Developers are obliged to share their improvements with us and we are now able to enforce this.
Many people contribute to an open Source projects, it is not for anyone to take these contributions and launch private versions. The GPL is clear that improvements must be returned to the licensor.
